U.S. Employer Requirements

Each employer is pre-screened by the Work and Travel USA sponsor to ensure they meet the program requirements. Important points that employers must follow: 1. Completing and signing the job offer: The employer must give each participant a formal job offer that both parties must sign. 2. Provision of Hours of Work: The employer must provide the participant with the number of hours of work specified in the signed job offer. 3. Seasonal nature of work: Work must be seasonal. The program sponsor, InterExchange, may request supporting documentation from the employer about the seasonality of the business, or financial statements if it is not obvious. 4. Minimum Wage Compliance: An employer must comply with all federal, state, and local laws regarding the payment of minimum wages. 5. Overtime Pay: An employer is required to pay overtime in accordance with state law. 6. Employer Documents: The employer must provide a federal tax identification number (EIN), a copy of a valid company license, and workers' compensation insurance information to the program sponsor. If any of these documents have expired, the program sponsor may request updated documents. 7. Prohibition on assisting with visa violations: The employer must not assist participants to remain in the U.S. after the program ends. In addition, the employer should remind participants to apply for a Social Security Number.
